Restoring FCRA Registration After a Compliance Lapse
A Pune trust lost its FCRA registration after two missed annual returns, blocking committed European donor funds. We restored registration within eight weeks — and strengthened the donor relationships in the process.
What the engagement demanded.
A Pune-based trust doing livelihood and women’s skilling work had its FCRA registration suspended after missing the annual return filing for two consecutive years. The trust had relied on a single person for all compliance, and when that person moved on, the filing simply did not happen. Without FCRA registration, incoming contributions from two European donor organisations were blocked, and the trust had no way to receive the funds it had already been committed for the next programme cycle.
How we executed the engagement.
Outstanding Returns Filed
Filed both outstanding FCRA annual returns with the Ministry of Home Affairs.
Representation to MHA
Submitted a detailed representation explaining the lapse and evidencing that all foreign contributions during the gap period had been applied correctly and in line with donor intent.
Compliance Rebuild
Rebuilt the trust’s compliance infrastructure: a dedicated FCRA bank account audit trail and a utilisation certificate process aligned with donor reporting formats.
Compliance Calendar
Created a calendar of all FCRA, income tax, and Bombay Public Trusts Act filings, with responsibility clearly assigned.
The capabilities we brought to bear.
FCRA Return Filing
Preparation and filing of overdue FCRA annual returns with the Ministry of Home Affairs.
Representation & Advocacy
A detailed representation evidencing correct, donor-aligned application of all foreign contributions during the gap period.
FCRA Audit Trail
A dedicated FCRA bank account audit trail and a utilisation certificate process matched to donor reporting formats.
Multi-Statute Compliance Calendar
An assigned-responsibility calendar covering FCRA, Income Tax, and Bombay Public Trusts Act obligations.
The results we delivered.
FCRA registration was restored within eight weeks of the representation being filed, and the blocked contributions were received in the following cycle.
For an NGO, a compliance lapse is not just a regulatory problem. It is a relationship problem with donors who need to trust that their money is being handled correctly. Restoring both at once is the only outcome that matters.
