Maternity Leave Benefit

Maternity Leave Benefit refers to the paid leave and related benefits provided to a female employee during pregnancy and after childbirth, as per applicable labour laws in India.

1. Duration of Maternity Leave

Under the Maternity Benefit Act, 1961:

  • Up to 26 weeks of paid leave for the first two children

  • Maternity leave salary is treated as normal salary income
  • Fully taxable under the head “Income from Salary”
  • No separate tax exemption available
