Rectification Request

A Rectification Request is a process through which a taxpayer can request the Income Tax Department to correct mistakes apparent on record in an order or intimation issued under the Income Tax Act.

It is commonly used to fix errors in processed returns or assessment orders.

1. When to File a Rectification Request

A rectification request can be filed in cases such as:

  • Incorrect tax calculation in intimation
  • TDS or tax credit not considered
  • Mismatch with Form 26AS or AIS
  • Wrong carry forward of losses
  • Clerical or apparent errors in assessment

2. What Can Be Rectified

Only mistakes apparent on record can be corrected, such as:

  • Arithmetic errors
  • Data entry mistakes
  • Incorrect application of tax rates
  • Omission of available tax credits

Complex issues or disputes cannot be resolved through rectification.

3. Time Limit

  • Rectification request can generally be filed within 4 years from the end of the financial year in which the order was passed

4. Mode of Filing

  • Filed online through the income tax e-filing portal
  • Requires selection of relevant assessment year and request type
  • Supporting details or documents may be required

5. Outcome of Rectification

After processing:

  • Error may be corrected
  • Demand may be reduced or removed
  • Refund may be issued (if applicable)
  • Request may be rejected (if not valid)

6. Rectification vs Appeal

  • Rectification: For obvious errors
  • Appeal: For legal disputes or interpretation issues

Choosing the correct route is important.

7. Common Mistakes

  • Using rectification for complex disputes
  • Not checking Form 26AS/AIS before filing
  • Missing time limits
  • Providing incomplete details
