Form 10B –
Trust Audit Report for Charitable Trusts, Section 12AB & Section 11 Exemption India
Form 10B is the CA-certified audit report that charitable trusts and NGOs must file before their income tax return. Without a valid Form 10B filing, a registered trust cannot claim Section 11 exemption. Missing the due date directly endangers the trust's tax-exempt status for the entire year.
Overview
What Is Form 10B?
Form 10B is the audit report prescribed under Section 12A(b) of the Income Tax Act for charitable and religious trusts. A Chartered Accountant certifies this report after auditing the trust's accounts, verifying Section 11 conditions, and confirming fund application patterns. Form 10B also covers compliance with Section 11(5) investment rules and accumulation disclosures under Section 11(2).
N D Savla & Associates provides complete Form 10B filing services — trust account review, Section 11 exemption audit, investment compliance verification, and online portal upload. Our Form 10B service connects with our Trust Audit Services and ITR-7 Return Filing — covering the complete trust tax compliance cycle from audit to return submission.
Form 10B vs Form 10BB vs Form 10BA — Which Applies?
Form 10B
For trusts registered under Section 12AB claiming Section 11 exemption
- Charitable & religious trusts with 12AB registration
- NGOs with Section 12AB approval
- Section 8 companies with Section 11 exemption
- Required when income > ₹5 lakh before exemption
- CA uploads via their own portal login
Form 10BB
For institutions claiming exemption under Section 10(23C)
- Universities & educational institutions
- Hospitals & medical institutions
- Government-approved bodies under 10(23C)(vi)
- Research associations, news agencies
- No Section 12AB registration needed
Form 10BA
A donor-facing declaration — not an audit report
- Filed by trusts claiming deductions under Section 80G(2)(b)
- Not an audit certification — a compliance declaration
- Issued to each donor above the prescribed threshold
- Separate from Form 10B — both may apply to the same trust
- No income threshold for applicability
Applicability
Who Must File Form 10B?
Form 10B filing is mandatory for specific categories of trusts. Understanding the threshold and conditions prevents compliance gaps that cost the trust its entire year's exemption. Our ITR-7 Return Filing service identifies whether Form 10B applies before the ITR-7 filing process begins.
✓ Form 10B Is Required
- Charitable or religious trust with total income above ₹5 lakh — before claiming Section 11 exemption
- Trust registered under Section 12AB — regardless of income level — that applies income outside India
- Trust making investments not in accordance with Section 11(5) permitted instruments
- Trust claiming accumulation under Section 11(2) for unapplied income — Form 10B certifies the accumulation purpose and period
- Any trust that previously failed to meet the 85% application condition and accumulated income
✗ Form 10B Not Required
- Small trusts with total income below ₹5 lakh before Section 11 exemption — and no overseas income application or non-11(5) investments
- Trusts that do not claim any Section 11 exemption and pay regular tax on all income
- Institutions claiming exemption under Section 10(23C) — they file Form 10BB instead
- Trusts that are fully exempt from income tax under other provisions and do not hold Section 12AB registration
Even small trusts below the ₹5 lakh threshold must maintain proper books of account and file ITR-7 on time. Failure to file ITR-7 is a separate violation — independent of the Form 10B requirement.
What It Covers
Form 10B — Four Parts of the Trust Audit Report India
The revised Form 10B (effective AY 2023-24) contains significantly more detailed clauses than the earlier version. Each part must be completed accurately — a deficiency in any part compromises the Section 11 exemption audit report certification. Our Trust Audit Services review all four parts before certifying Form 10B.
Trust Registration and Activity Details
Captures the trust's registration details — Section 12AB registration number, registration date, and period of validity. Requires details of all trustees and their PAN numbers. The CA also certifies the nature of activities conducted during the year and confirms that those activities align with the stated charitable objects in the trust deed. Any deviation between registered objects and actual activities requires explanation in Part A.
Income, Application, and Section 11 Verification
The core of the Section 11 exemption audit report. Verifies gross income from all sources, amounts applied to charitable purposes in India, unapplied income, and any accumulation under Section 11(2). The CA confirms whether the 85% application condition is met. Part B also flags income from business activities — which attracts separate treatment under Sections 11(4) and 11(4A). Where the 85% condition is not met, Form 10 must be filed before the Form 10B due date to protect the accumulation benefit.
Investment Compliance Under Section 11(5)
Checks that all corpus and accumulated funds are invested only in Section 11(5) permitted instruments — government securities, bank fixed deposits, post office savings, and similar safe instruments. Any investment outside these categories jeopardises the Section 11 exemption audit report certification. The CA verifies the year-end investment register against the balance sheet. Our Trust Audit Services review the investment register as a first step in each Form 10B engagement — flagging non-compliant placements before the formal audit begins.
Voluntary Contributions and Corpus Donations
Captures all voluntary contributions received during the year — separating corpus donations, general donations, and anonymous contributions. Corpus donations go to the trust's permanent fund and do not count toward the 85% application requirement. However, anonymous donations above ₹1 lakh attract tax at 30% flat under Section 115BBC — and Part D flags these separately in the trust audit report India. Trusts must maintain donor registers with PAN details for every contribution above ₹2,000 to avoid anonymous donation tax exposure.
Filing Deadline
Form 10B Due Date — When to File
The Form 10B due date is directly linked to the trust's ITR-7 filing deadline. Missing it causes a cascade of compliance failures — a delayed ITR-7, loss of Section 11 exemption, and potential scrutiny of prior year exemption claims.
For AY 2025-26, trusts requiring a Form 10B audit must ensure the CA uploads the report before 31 October 2025. We schedule audits from August onwards to meet this deadline comfortably.
Form 10B must be uploaded at least 48 hours before the trust's ITR-7 is submitted. The CA uploads through their own portal login and the acknowledgement number is quoted in the ITR-7 return. Our ITR-7 Return Filing service handles the ITR-7 submission immediately after Form 10B acknowledgement.
Missing the Form 10B due date means the trust loses Section 11 exemption for the entire year — all income becomes taxable at maximum marginal rate. The Income Tax Department can also treat non-filing as a violation of Section 12A(b) — potentially triggering a Section 12AB registration review.
A Section 11 exemption audit report filed late can trigger scrutiny of the trust's exemption claims for prior years — not just the current year. Our Income Tax Notice advisory handles trust notices arising from delayed Form 10B filing and exemption scrutiny.
How We File It
Form 10B Filing Process — Step by Step
The Form 10B filing follows a three-step sequence — from trust account finalisation through CA portal upload and ITR-7 coordination. Each step must complete in order before the Form 10B due date.
Trust Account Finalisation and Pre-Audit Review
CA Audit — Clause-by-Clause Verification
CA Portal Upload and ITR-7 Coordination
What to Gather
Documents Required for Form 10B Filing
Preparing Form 10B accurately requires collecting and reviewing a comprehensive set of trust records before the audit begins. Incomplete records are the most common cause of delays that push Form 10B past the deadline. Reconciling TDS credits before the trust audit report India certification also prevents Section 143(1) notices after ITR-7 submission.
Trust Governance and Registration Records
- Trust deed — to verify charitable objects, trustee names, and operational provisions. Any deed amendments must be available for Part A disclosure in the Section 12AB charitable trust audit
- Section 12AB registration certificate — with registration number and validity dates. The Form 10B filing captures this in Part A
- 80G registration certificate — where the trust issues 80G deduction certificates to donors
- Trustee PAN details — all current trustees' details are mandatory in Part A of Form 10B
- Form 10 filed for Section 11(2) accumulation — where applicable, must predate the Form 10B due date
Financial and Compliance Records
- Audited income and expenditure account and balance sheet
- Receipts and payments account — showing all inflows and outflows during the year
- Donor register with PAN details — for voluntary contribution disclosure in Part D of Form 10B. All donors above ₹2,000 need PAN details to avoid 30% anonymous donation tax under Section 115BBC
- Investment register with Section 11(5) compliance details — listing every corpus fund and accumulated fund investment. Our Trust Audit Services review this before signing Form 10B
- Form 26AS — for TDS deducted on trust income (interest, rent). We reconcile TDS credits before the trust audit report India certification to prevent post-filing notices

Form 10B is the Chartered Accountant-certified trust audit report India required for charitable and religious trusts claiming Section 11 exemption. Trusts registered under Section 12AB with total income above ₹5 lakh — before the exemption — must file Form 10B before their ITR-7 due date. Additionally, trusts making investments outside Section 11(5) or applying income outside India also need the Section 11 exemption audit report regardless of income level. Our Trust Audit Services confirm Form 10B applicability for each trust.
The Form 10B due date aligns with the ITR-7 filing deadline — 31 October 2025 for audit trusts for AY 2025-26. The CA must upload Form 10B on the income tax portal before the ITR-7 form submission. Furthermore, we recommend completing Form 10B filing at least two weeks before the ITR-7 due date — to allow time for any corrections.
Form 10B applies to trusts registered under Section 12AB claiming Section 11 exemption. Form 10BB applies to institutions claiming exemption under Section 10(23C) — universities, hospitals, and government-approved bodies. The clauses in Form 10B vs Form 10BB differ significantly. Filing the wrong form invalidates the exemption claim for the year. Our ITR-7 Return Filing service identifies the correct form before the trust audit report India begins.
Failure to file Form 10B before the due date means the trust cannot claim Section 11 exemption for that year. Consequently, the entire trust income becomes taxable at the maximum marginal rate. Additionally, the Income Tax Department can treat the non-filing as a violation of Section 12A(b) conditions — potentially triggering a registration review. Our Income Tax Notice advisory handles trust notices and responds to exemption-related queries
Section 12AB charitable trust audit in Form 10B covers registration compliance, income application percentages, Section 11(5) investment verification, voluntary contribution disclosures, and trustee details. Additionally, the CA certifies that the trust’s activities align with its stated charitable objects and that the trust complies with all conditions for Section 11 exemption. Furthermore, Part B specifically verifies whether the 85% income application condition is satisfied.
Yes — but only if the trust files Form 10 before the Form 10B due date. Under Section 11(2), a trust can accumulate unapplied income for up to 5 years after filing Form 10 specifying the purpose and period. Furthermore, the accumulated amount must invest in Section 11(5) permitted instruments. The Form 10B filing then certifies the accumulation details in Part B of the trust audit report India. Our Trust Audit Services coordinate Form 10 filing alongside Form 10B preparation.
