Karta
Karta is the head and manager of a Hindu Undivided Family (HUF). The Karta is responsible for managing the financial, legal, and tax affairs of the HUF and represents it in all transactions and proceedings.
Traditionally the eldest male member, the law now allows a female member to act as Karta.
1. Role of the Karta
The Karta has primary control over the HUF and is responsible for:
- Managing HUF assets and investments
- Taking business and financial decisions
- Representing the HUF before authorities
- Filing income tax returns on behalf of the HUF
2. Powers of the Karta
The Karta has wide powers, including:
- Entering into contracts on behalf of the HUF
- Operating bank accounts
- Borrowing funds for HUF purposes
- Managing business activities of the HUF
These powers are broad but must be exercised in the interest of the HUF.
3. Responsibilities of the Karta
With authority comes responsibility:
- Maintain proper accounts and records
- Ensure tax compliance and filings
- Act in good faith for all members
- Avoid misuse of HUF funds
4. Who Can Become Karta
- Senior-most coparcener of the HUF
- Can now be male or female (as per legal developments)
- Must be capable of managing HUF affairs
5. Liability of the Karta
- Generally represents the HUF in all liabilities
- Can be held accountable for mismanagement
- HUF assets are primarily liable for debts
6. Karta vs Coparcener
- Karta: Manager and decision-maker
- Coparcener: Member with ownership rights in HUF property
Not all members are Kartas, but all coparceners have rights in property.
7. Common Mistakes
- Treating HUF funds as personal funds
- Not maintaining proper records
- Ignoring tax compliance
- Making decisions without clarity on ownership rights
Practical Insight
Most HUF issues aren’t legal, they’re operational.
The Karta sits at the center of:
- control
- compliance
- trust
If the Karta maintains clear records and discipline, HUF works smoothly.
If not, it creates disputes and tax problems.
