Maternity Leave Benefit refers to the paid leave and related benefits provided to a female employee during pregnancy and after childbirth, as per applicable labour laws in India.

1. Duration of Maternity Leave
Under the Maternity Benefit Act, 1961:
- Up to 26 weeks of paid leave for the first two children
- Up to 12 weeks for subsequent children

- She has worked for at least 80 days in the 12 months preceding the expected delivery date

- Maternity leave salary is treated as normal salary income
- Fully taxable under the head “Income from Salary”
- No separate tax exemption available
